About these terms

These terms apply when you ask Off Road Buyers Ltd ("we", "us") for an offer, whether through this website, by phone, by email or on WhatsApp, and when you sell us a machine. They also cover your use of offroadbuyers.co.uk. Our registered company details, including the company number, sit at the foot of each page on this site. Please read them before you accept an offer. If anything isn't clear, contact us.

1. Our offers

1.1 Our offer is based on the information and photos you give us. It's free and there's no obligation to accept it.

1.2 An offer isn't binding on you. It becomes an agreed sale when you accept it and we arrange collection.

1.3 We'll tell you how long an offer stands when we make it. After that, we may need to check the price again before we collect.

1.4 If the machine matches what you told us, the agreed price stands on the day. If we find it doesn't match the description (for example an undisclosed fault, a different model or year, missing parts or missing paperwork), we'll explain the difference and may offer a revised price. You're free to accept it or decline it. There's no charge either way, including for a wasted trip.

1.5 We may decline to make an offer, or to go ahead with a purchase, at any point before we pay you. For example, if the ownership checks in section 3 aren't satisfied.

2. Your promises to us

When you sell us a machine, you confirm that:

• you own it, or you have the authority to sell it on behalf of its owner (such as a business, partnership or farm);
• it isn't stolen, and nobody else has a claim to it apart from any finance you've told us about;
• its frame, VIN and engine numbers haven't been altered or removed;
• everything you've told us about it, including its history, faults, write-off status and any modifications, is true to the best of your knowledge.

If any of these turns out to be untrue, we can cancel the sale, and you must repay anything we've paid you, including any money paid to a lender on your behalf.

3. Checks we make

3.1 Before we pay, we check your photo ID, proof of ownership (such as the V5C, the original invoice or receipt, or a finance settlement letter) and the frame or VIN number on the machine.

3.2 If we can't be satisfied that the machine is yours to sell, we won't buy it. Where the law requires or allows it, we may share information with the police or other authorities, for example if a machine may be stolen.

4. Collection

4.1 Collection is free across Kent, London and the South East, with UK-wide collection by arrangement. We'll agree a day with you when you accept the offer.

4.2 Please give us safe, reasonable access to the machine and tell us in advance about anything that might affect collection, such as a narrow lane, soft ground or a machine that doesn't run.

4.3 Please remove your personal belongings, and any trackers or number plates you want to keep, before we load. Please hand over all keys, and any chargers, spare batteries or attachments included in the price.

5. Payment

5.1 We pay by bank transfer, before we load the machine. You'll be able to check the money has arrived in your account before the machine moves.

5.2 We don't charge fees, commission or collection charges, and we don't take anything off the agreed price.

5.3 If there's finance outstanding, we pay the lender the settlement figure directly and pay you the balance. If the settlement figure is more than the agreed price, the difference must be settled with the lender before we can buy the machine.

5.4 Ownership of the machine passes to us when we have paid you.

6. Changing your mind

6.1 You can change your mind about selling at any point before we pay you, at no cost.

6.2 Once we've paid you and loaded the machine, the sale is complete.

7. After the sale

7.1 Apart from the promises in section 2, we buy the machine in the condition we see it on the day. We won't come back to you about faults we find later, unless you gave us information you knew was false.

7.2 If the machine is registered, the registered keeper is responsible for telling the DVLA it has been sold.

8. Using our website

8.1 The information on this site, including our guides, is general information and not legal or financial advice. Rules change, so check GOV.UK before relying on anything about the law.

8.2 We try to keep the site accurate and available, but we can't promise it will always be free from errors or interruptions.

8.3 Where we link to other websites, we're not responsible for their content.

8.4 Please don't misuse the site, for example by sending false enquiries, trying to break our forms or uploading anything harmful or offensive.

9. Our liability

9.1 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited or excluded by law.

9.2 We're not responsible for losses that weren't a foreseeable result of us breaking these terms. If you sell to us as a business, we're not responsible for loss of profit, loss of business or indirect loss.

9.3 Otherwise, our total liability to you in connection with any sale is limited to the price agreed for the machine.

9.4 We're not responsible for delays or failures caused by events outside our reasonable control, such as extreme weather or road closures. If that happens, we'll rearrange collection with you.

10. Your information

We use your personal information as explained in our privacy policy. Our use of cookies is explained in our cookie policy.

11. Complaints

If you're unhappy with anything we've done, please contact us and we'll try to put it right.

12. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.

13. Changes to these terms

We may update these terms from time to time. The version that applies to your sale is the one on this page when you accept our offer. When these terms change, the revision date at the top of this page moves with them.
